Where did that collection come from? I had a long Teams session with an old friend wrestling with certifying collections made by corporate clients. He raised many legitimate concerns regarding Microsoft 365 search limitations and source complexities. The conversation inspired me to create a fast Purview eDiscovery collection checklist to covering the overall decisions, scope, criteria and process. While I prefer formal protocols and automated documentation, this kind of checklist is a stop gap tool that serves many purposes.
First it allows the corporate legal team to document their efforts and communicate them to retained counsel and service partners. Second, the list may remind them of options and considerations frequently overlooked in the rush to ‘pump and dump’ custodial content. Third, it is a contemporaneous record of decisions that may have downstream impact or require defense of process.
