There are hundreds of e-discovery software applications available. Every stage of the EDRM can be assisted by one or more commercially available applications. Some of these are designed for very specific functions, such as trial presentation, while others claim to have multiple parts that can be used at different EDRM stages, such as software that collects, processes, analyses and reviews electronic information. The marketing collateral that accompanies many of these products proclaim each of them as “the best” at what they do. They advertise various types of functions, such as near duplicate identification, conceptual clustering, predictive coding, etc. With all the different options available, how can one filter out the “sales-speak” and actually evaluate an e-discovery offering on its merits? The following tips may help: 1. Make sure the software fits you, not the other way around The reason you [...]

PART TWO OF INTERVIEW WITH JONATHAN WILAN Partner at Hunton & Williams LLP With the exploding rate of data growth, data remediation is a serious exercise that all companies must consider. In part one of this series, I spoke with Jonathan Wilan, Partner at Hunton & Williams LLP, about the risks of not having a data remediation policy. In this part two, we discuss what departments should be involved in data remediation efforts, what the return on investment is, and how to measure this. Amber Scorah: What are the relevant departments that must be involved in data remediation efforts? Jonathan Wilan: To succeed, a remediation project will require involvement of a number of departments. Obvious stakeholders will include IT and Records Management. It is absolutely essential (for the legal preservation obligation reasons I discussed previously) that the Legal Department be [...]

Most of the conversation these days in the eDiscovery arena has been around Predictive Coding, the Cloud, and Big Data topics, so I wanted to bring us back to one of the basic issues in the eDiscovery marketplace…pricing. The Predictive Coding/Technology Assisted Review (PC-TAR) makes the world a bit fuzzier as it blends the processing and review components closer together. I’m sure many vendors long for the days when the going price to process (extract the meta-data and text) and create a TIFF was $2500 per GB (uncompressed). The process was simple back then…process and TIFF the data…load it up into a review platform and let the attorneys review to their hearts content (Excel files notwithstanding). Even when we developed the technology to apply search terms to the data set, the price was based on how much data went into [...]

Another successful Executive Counsel Institute – eDiscovery for the Corporate Market event (“The Exchange”) was held in Los Angeles December 5 and 6. I have participated in this conference multiple times in the past and, once again, was not let down. The Los Angeles meeting, lead by Browning Marean of DLA Piper and Robert Brownstone of Fenwick & West, was the last of the five held across the U.S. this year. The round-table format sets this event apart from other conferences. The Exchange, which is a strictly “PowerPoint free” zone, is rich in content and participation. While there is an agenda and moderators for each session, the meeting is steered by participant needs. The Exchange is kicked off with an audience poll of pain points and goals for conference take-aways, all of which are included in the 1-½ day discussion.
I was happy to see Greg Buckles’ post Has eDiscovery Disenfranchised Our Paralegals. The answer is, wholeheartedly, YES! So, why am I happy? I am happy because someone finally brought the topic up publicly. It is a very real problem that the legal industry needs to address. Instead, however, we seem to be treating the subject as taboo or simply shrugging our shoulders. Buckles correctly identified the problem and how it came into existence. It happened without anyone noticing. The disconnect between paralegals and the litigation support process has caused significant tension within legal teams. In my experience, this holds true in both law firms and in-house legal departments, as well as between outside and in-house counsel. Buckles also correctly identified the solution: improved chain of custody processes that keep the stakeholders engaged and informed through every step of evidence [...]
